Official Rules

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

This promotion (hereinafter “Promotion”) is organized by GameDuell GmbH, Taubenstr. 24-25, 10117 Berlin, Germany (hereinafter “Grand Gin Rummy Team”).

Prize: 15 packages including a Grand Gin Rummy mug and a Grand Gin Rummy card deck; A package has an approximate retail value of 15 USD.

Eligibility: The Promotion is free to enter and open to all individuals who are legal residents of the United States of America, and, at the time of their participation, have reached the legal age of their individual residence (“you”). It is your responsibility to ensure that you are legally eligible to enter the Promotion under any laws applicable to you in your jurisdiction of residence or otherwise. The employees, officers and directors of the Organizer as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee, are not eligible to participate in the Promotion. The Promotion is void outside the Region, and where otherwise prohibited by applicable federal, state, provincial or local laws, rules or regulations.

How to Enter: To enter the Promotion, you need to comment “Grand Gin Rummy” on our holiday giveaway post on Facebook during the duration of the Promotion. If you fail to adhere to the Official Rules or any other requirements, your participation will be considered void.

Agreement to Official Rules: Whether or not you receive a prize is contingent upon fulfilling all requirements set forth in these Official Rules or elsewhere and being randomly chosen as a winner (“Winner”). The Promotion is subject to all applicable federal, state, and local laws. The Promotion is void where prohibited by law.

The Grand Gin Rummy Team determines if you meet the requirements and otherwise comply with the Official Rules.

Your Representations and Warranties: By entering the Promotion, you represent and warrant that your comment will not be offensive, harassing, blasphemous, pornographic, defamatory, obscene, inappropriate, unlawful or otherwise objectionable.

Prizes: The Organizer will provide the Prize(s) to be awarded for a particular Promotion. No substitution of a Prize will be made unless the Organizer, in its sole discretion, determines otherwise. A Prize must be accepted as awarded, and the odds of winning are dependent upon the total number of eligible participants in the Promotion. A Prize is personal to the Winner and is non-transferable. Each Winner is responsible for all taxes and fees associated with receipt of the Prize. To obtain a copy of the Winners names, mail your request along with a stamped, self-addressed envelope to: GameDuell GmbH, Taubenstr. 24-25, 10117 Berlin, Germany. Requests must be received no later than March 31^st, 2017.

General Conditions: If you are a Winner, your name and address will be solely used to send you the prize. Your data will be deleted thereafter and not be used by the Organizer for marketing purposes, nor passed onto any third parties.

If you use fraudulent methods, or otherwise attempt to manipulate the Promotion, you will be disqualified.

The Grand Gin Rummy Team reserves the right to cancel, modify or suspend the Promotion at any time, if it is determined that the Promotion cannot be run as originally planned or if fraud or any other occurrence compromises the fairness or integrity of the Promotion.

LIMITATIONS OF LIABILITY AND RELEASE: BY POSTING A COMMENT, YOU AGREE THAT THE GRAND GIN RUMMY TEAM AND ITS EMPLOYEES, OFFICERS, DIRECTORS, AGENTS, CONTRACTORS, REPRESENTATIVES, AFFILIATES, DIVISIONS, SUBSIDIARIES, RESELLERS, DEALERS, DISTRIBUTORS, AND FACEBOOK, INC. WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE RELEASED AND HELD HARMLESS BY YOU AND YOUR HEIRS, EXECUTORS, REPRESENTATIVES, SUCCESSORS AND ASSIGNS FOR ANY CLAIMS, LIABILITIES, OR CAUSES OF ACTION OF ANY KIND OR NATURE FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES TO PERSONS, INCLUDING, WITHOUT LIMITATION, DISABILITY OR DEATH, AND DAMAGE TO PROPERTY, DUE IN WHOLE OR IN PART, ARISING DIRECTLY OR INDIRECTLY, NOW OR IN THE FUTURE FROM THE DELIVERY, ACCEPTANCE, USE OR MISUSE OF THE PRIZE, OR PARTICIPATION IN THIS PROMOTION. WITHOUT LIMITING THE FOREGOING, THE PROMOTION SITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, IN WHICH CASE SUCH LIMITATION OR EXCLUSION SHALL APPLY ONLY TO THE EXTENT PERMITTED BY THE LAW IN THE RELEVANT JURISDICTION.

Choice of Law: The Promotion and these Official Rules shall be governed by and construed in accordance with the laws of Germany, without reference to its conflicts of laws principles. Any and all disputes or claims arising out of or connected with this Promotion, shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany. Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Promotion, but in no event attorneys’ fees. You hereby waive all rights to: (i) claim or be awarded any punitive, direct, indirect, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses; and (ii) to have damages multiplied or otherwise increased.
